TERMS OF USE AGREEMENT
The dremeltv.com website is operated by Dremel, a division of Robert Bosch Tool Corporation, ("Dremel"). By visiting the dremeltv.com site or by using any of the services provided on the dremeltv.com site (collectively, "the Site"), you hereby agree to be bound by all of the following terms and conditions (“Terms of Use”) and accept the terms and conditions of our Privacy Policy.
Copyright Notice and Limitations on Use
All of the information, content images and graphics (collectively, the “Content”) within this Site are protected by copyright and other intellectual property laws. The Content is owned by Dremel and its affiliated companies, licensors and suppliers. The Content is intended for personal use only. While you may interact with or download a single copy of any portion of the Content for your personal, noncommercial entertainment, information or use, you may not reproduce, sell, publish, distribute, modify, display, repost or otherwise use any portion of the Content in any other way or for any other purpose without the written consent of Dremel. You acknowledge that the Content includes certain trademarks and service marks owned by Dremel and/or its affiliates, including DREMEL®, TOOLS FOR THE IMAGINATION®, MULTIPRO®, D-VISE®, MOTO-FLEX®, MINIMITE®, CHAINSAVER®, ADVANTAGE™ and certain other word and design marks. You agree not to copy, use or otherwise infringe upon these trademarks or service marks. You further agree that you will not alter or remove any trademark, copyright or other notice from any copies of the Content. DREMEL® , TOOLS FOR THE IMAGINATION®, MULTIPRO®, D-VISE®, MOTO-FLEX®, MINIMITE®, CHAINSAVER® are registered trademarks of Credo Technology Corporation, an affiliate of Dremel. Other product and company names herein may be trademarks of their respective owners.
If you operate a website and wish to link to the Site, you must link to the Site’s home page unless permission otherwise has been granted in writing by Dremel. Dremel reserves the right to reject or terminate any links to the Content or the Site. Dremel will not be held liable in any way to you or to any third party or to any other person who may receive Content from the Site for any delays, inaccuracies, errors or omissions in such Content or in the transmission or failure to transmit all or any part thereof or for any damages arising from any of the foregoing.
Posting Content on the Site
By placing material on the Site or communicating with Dremel, you hereby grant to Dremel the royalty-free, perpetual, irrevocable, nonexclusive right and license to use, copy, modify, display, distribute and reproduce all such materials in any form, media, software or technology of any kind now existing or developed in the future. You also agree to indemnify, defend and hold Dremel harmless from and against any and all damages, claims or costs, including attorneys’ fees, arising from the use, display or distribution of those materials. You further grant to Dremel the right to use your name in connection with the reproduction or distribution of such material.
Dremel does not accept unsolicited materials or ideas for use or publication on the Site or in other digital, electronic or print media except in connection with the designated areas on the Site. Dremel shall not be responsible for the similarity of any of its Content in any media to materials or ideas transmitted to Dremel.
Copyright Claims and Designated Agent
It is the policy of Dremel to respond to claims of intellectual property infringement. Dremel will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) (“DMCA”) and other applicable intellectual property laws.
Pursuant to the DMCA, notifications of claimed copyright infringement should be sent to a Service Provider’s Designated Agent. Notification must be submitted to the following Designated Agent for this site:

To be effective, the notification must be a written communication that includes the following:

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address at which the complaining party may be contacted;

6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Product Orders
While we will use our best efforts to fulfill all orders, Dremel cannot guarantee the availability of any particular product displayed on this Site. Dremel reserves the right discontinue the sale of any product listed on this Site at any time without notice.
The prices displayed on this Site are quoted in U.S. dollars and are valid and effective only within the United States, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for the payment of any shipping and handling charges and state and local sales or use taxes that may apply to your order.
While our goal is a 100% error-free Site, we do not guarantee that any content is accurate or complete, including price information and product specifications. If we discover price errors, they will be corrected on our systems, and the corrected price will apply to your order. Dremel reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted).

YOU ACKNOWLEDGE AND EXPRESSLY AGREE THAT USE OF THE SITE IS AT YOUR OWN RISK. DREMEL CANNOT AND DOES NOT VERIFY OR WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION CONTAINED ON THE SITE. NEITHER DREMEL, NOR ANY OF ITS EMPLOYEES, AGENTS, CONTENT PROVIDERS OR LICENSORS, MAKES ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND REGARDING THE SITE, THE CONTENT, ANY PRODUCTS OR SERVICES, ANY ADVERTISING MATERIAL OR THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE OR ANY PRODUCT OR SERVICE FEATURED ON THE SITE. THE SITE IS PROVIDED ON AN “AS IS” AND "AS AVAILABLE" BASIS, AND DREMEL SPECIFICALLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, WARRANTIES OF MERCHANTABILITY OR WARRANTIES AGAINST INFRINGEMENT.
DREMEL, ITS AFFILIATES, EMPLOYEES, AGENTS, CONTENT PROVIDERS AND LICENSORS SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES OR LOSSES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, RESULTING FROM OR CAUSED BY THE SITE OR ITS CONTENT, INCLUDING, WITHOUT LIMITATION, LOSSES RELATED TO: YOUR USE OR INABILITY TO USE THE SITE; ANY ERRORS, OMISSIONS OR DEFECTS IN THE CONTENT; OR ANY INTERRUPTIONS, DELAYS IN TRANSMISSION OR COMPUTER VIRUSES. YOU AGREE TO RELEASE, HOLD HARMLESS AND INDEMNIFY DREMEL FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM INCORRECT OR INCOMPLETE INFORMATION ON THE SITE.
Changes to the Terms of Use and/or Privacy Policy
Dremel reserves the right at its discretion to change these Terms of Use and/or its Privacy Policy and will notify users of any such changes by posting such changes on the Site. Your continued use of the Site after the posting of any amended Terms of Use or amended Privacy Policy shall constitute your agreement to be bound by any such changes. Dremel may modify, suspend, discontinue or restrict the use of any portion of the Site, including the availability of any portion of the Content at any time, without notice or liability.
Governing Law and Exclusive Venue
These Terms of Use and the Privacy Policy will be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflicts of law provisions. You hereby agree that any cause of action you may have with respect to the Site must be filed in the federal or state courts located in Chicago, Illinois, within one year after the cause of action arises or the cause is barred.
